WEBSITE USER AGREEMENT

Use of the Homeplan Finance UK Limited, ("we", "us", "Homeplan") website ("the site") constitutes acceptance of the site User Agreement ("the agreement") and Terms of Use ("terms"). The user of the site ("you") represents that you have read and understood these terms and have agree to be bound by them. If you do not agree to all the terms and conditions on this page, please do not use this website. Use of any internal or external links on the Homeplan website constitutes acceptance of the terms on this page. If you do not agree with these terms, please exit this site by closing the browser window.

The terms "Homeplan", "Homeplan Finance.co.uk" "Homeplan Finance UK Limited" encompasses the Homeplan Internet Site and Marketing Communications.

In order to use this site you must agree to be legally bound and to abide by the terms and to indemnify and hold the operators of the Homeplan website harmless from all alleged or actual damages, claims and expenses relating to any warrant, guarantee or representations made by the individual service providers featured within this website or linked websites. This also includes, without limitation, attorney's fees. The use of this site for any reason is deemed to be an agreement of this condition.

TRANSPARENCY

This independently owned website acts as an advertising and marketing vehicle to attract passive enquires (from people that are proactively searching for a mortgage using search engines or directories on the internet. There is no fee attached to the searcher (you) for this service. As such, Homeplan offers to provide you with a mortgage quotation free, provided that sufficient of your financial details are made known to us. The owners, webmasters and marketing professionals of this website are able to offer financial advice, and if you accept this advice and proceed with a mortgage application then this will incur a fee. More information about any fee which you could pay can be viewed within the Terms and Conditions attachment to this website and is a legal requirement under FSA Rules. Any information contained on the website does not form the basis of any contract. Business or financial decisions should not be based solely on the information contained within this website. Homeplan Finance UK Limited is a mortgage broker authorised by the FSA to arrange mortgages.

In giving such we will need to disclose your financial details to some third parties (lenders). A mortgage enquiry from this website does not constitute an offer to provide a mortgage. Your home is at risk if you do not keep up repayments on a mortgage or other loan secured on it. We must give you an indication on this website which provides you the user with an overall rate for comparison. The overall cost for comparison is 5.9% APR. The actual rate available will depend upon your circumstances. Ask for an illustration of the rate which applies to your circumstances. The APR we have used as a comparison may be different to what rate actually applies to you. It may be a variable rate or a fixed rate and is based on a typical case. This website has been approved by Homeplan Finance UK Limited which is an authorised intermediary regulated by the FSA (Authorisation Number 304150)

DISCLAIMERS

Bearing in mind that this is a free "public access" site, it is a condition of use of the site and the materials in it that it is used at the user's own risk. We give no warranty and assume no responsibility for any effect it may have upon your computer. We disclaim all liability in respect of any such occurrence which may harm your computer. Neither Homeplan nor any of the site's administrators, editors or contributors shall be liable for any loss or damages suffered as a result of any use of this site, including but not limited to direct loss, consequential loss and loss of profits. We do not assume, and therefore disclaim, any liability for any loss or damage caused by errors or omissions in any respect whatsoever in the use of the website.

AVAILABILITY OF SERVICE

We do not warrant or guarantee that the Homeplan website or Client Call Unit will be uninterrupted or free from error. However it is a live medium which is available 24 hours each day 365 days each year.

INFORMATION INDEMNITY

The user agrees not to rely on any information obtained from the Homeplan website and indemnifies us from mistakes, omissions, errors, interruptions, delays of service or performance, defects, harmful components, viruses and bugs, howsoever caused.

SEVERANCE

If a term, covenant, provision, or condition of this agreement becomes, or shall be held by any British court of competent jurisdiction to be against public policy or illegal, all remaining provisions of this agreement shall remain in full force and effect and unaffected, impaired or invalidated by this decision. The invalidated item shall be modified by the parties to the full extent possible to carry out all the intentions and directives stated in this agreement.

GOVERNING LAW

Any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England, and you and Homeplan Finance UK Limited irrevocably submit to the non-exclusive jurisdiction of the English Courts.

This agreement is governed by English law and all disputes will be handled solely in the United Kingdom. English Courts will have jurisdiction in respect of it. You consent to such venue and jurisdiction. The Homeplan website is controlled and operated from offices in the United Kingdom and makes no representations or warranties that its content or use is legal in other locations.

HEADINGS

Headings are for reading convenience only and are not to be used in the interpretation of this agreement.

VARIATION

Whilst it is not our intention to do so, the operators of the website reserve the right to change its policies and terms at any time. Any such change will not constitute a change to your legal rights or to our statutory obligations as they apply in English Law.

We do not assume, and therefore disclaim, any liability for any loss or damage caused by errors; omissions or amendments to the site content save in respect of your statutory rights or our legal obligations as they apply in English Law.

Homeplan Finance UK Limited is not associated with other companies who own similar sounding names. If you do not agree to all the terms and conditions on this page, please do not use this website. Use of any internal or external links on the website constitutes acceptance of these user terms and agreement.

DATA PROTECTION ACT 1998

I/we confirm that I/we have the consent of any third party whose details I/we may disclose to Homeplan Finance UK Limited and disclose such details to authorise Homeplan Finance UK Limited and third parties referred to in order to process such details for the purposes of assessing my/our application and administering and enforcing any subsequent loan or mortgage which may be granted to me/us.

I/we agree that You and any advisor resulting from this application (the "advisor") shall be entitled to use and process, by any medium, the information given by me/us in this application form and any other information about me/us which may be acquired during the lifetime of any loan ("the Data") for the following purposes:-

1. to provide the Data to and search the files of one or more credit reference or fraud prevention agencies whether before, or during the lifetime of any loan granted to me/us by the advisor, who will keep a record of such search, to confirm the Data, and for the purposes of credit assessment or account administration. I/we understand that you and /or the advisor will record false or inaccurate information if this is given by me/us and fraud is suspected.

2. To disclose the Data to credit reference agencies when requested by them for consideration of any future applications for finance made by me or members of my household/family, or for fraud prevention and/or tracing debtors (the agencies may also disclose the Data to other advisors for these purposes)

3. to disclose the Data to any other company within the advisor's group of companies and/or to any third parties (for example, debt counsellors and insurers) at any time for the purposes of assessing my/our application and administering and enforcing any subsequent loan whether during the course of my/our application or during the lifetime of any loan granted pursuant to such application;

4. To disclose the Data to any third party who replaces or who may replace my/our advisor.

PREVENTION OF MONEY LAUNDERING

The advisor and other organizations may use and search the records of credit reference or fraud prevention agencies to check your identity to prevent money laundering, unless you have furnished other satisfactory proof of identity.

RIGHT OF SUBJECT ACCESS

Information held by us will be processed only for purposes for which we have registered under the Data Protection Act. Upon you making a request in writing we will provide you with a copy of the information which we hold concerning you on payment of a fee.

PERSONAL DETAILS AND DATA PRIVACY

The personal details which you submit to us (Personal Data) are held by Homeplan Finance UK Limited for its own use. It is your responsibility to ensure that your Personal Data is accurate and up to date and to inform us of any changes that need to be made. Homeplan Finance UK Limited may use the Personal Data for the purposes they have notified to the Office of Information. By submitting your Personal Data you CONSENT to it being processed by Homeplan Finance UK Limited.

TRANSFER OF DATA TO THIRD PARTIES

In the unlikely event we are not able to assist you fully with your mortgage, i.e. If time is of the essence, or if your needs are such that a home visit is not possible for us, then you consent to us transferring your information to any third party with the aim to facilitate assistance to you further. The third party will contact you separately and will henceforth act independently from us. At such a time, any agreement you may have made with us will be void. We may receive a small 'marketing fee' for any such transfer from the third party. You will not pay us a fee if we do this and it is our aim to facilitate assistance or more specialist help with your mortgage. If you choose not to have your details disclosed in this way then you are at liberty to tell us. In which case we will be unable to facilitate any further assistance for you through a third party not hitherto mentioned or named by this agreement.

If your data is transferred then you will be informed of the name of any third party before you agree to us transferring your data to that party. You do not have to agree to our attempts to further facilitate your loan or mortgage in such circumstances as they may arise however unlikely.

Following our online quotation, if you decide to proceed with us to arrange your mortgage, then we will give you a Key Features Illustration (KFI) to help decide about your mortgage.
This document will contain detailed terms of the mortgage product, including the type of product, the interest rate and length of any special period of discount or fixed period for instance.

The adviser will show you how much it will cost and how the mortgage is arranged for you, and will explain the material facts about your mortgage.

We will usually help to meet any initial fees which may be required to value your property and to carry out lender administration and you will be asked to agree to repay us if you decide not to proceed with the mortgage offer we've arranged for you. The quote we provide will have this fee included to your new mortgage so you don't have to find it yourself initially, and once your mortgage has been completed then the solicitor will send us the amount you have agreed to pay us.

Please ensure you understand that all lenders carry out a valuation of your property before a mortgage can be arranged for you, and if Homeplan has paid this for you then Homeplan will want to be repaid.

Hopefully you will find this an easier method if you are unable to meet the cost of an upfront fee.

Homeplan will also carry out a second valuation in certain circumstances absolutely free if for reason not in your control we are unable to arrange the mortgage first time around. However this very rarely happens in our experience.
